GUIDANCE REGARDING SOLAR, LUNAR ECLIPSES

According to astronomical reports, Insha Allah a Solar Eclipse is expected to occur on Sunday, 21st of June, and a Lunar Eclipse is expected on Sunday, 05th of July this year.

According to reports, the Solar eclipse that is to occur on Sunday, 21st of June is expected to be visible in many parts of the globe as an ‘Annular Solar Eclipse’, while in Sri Lanka this may appear as a partial Solar Eclipse between 10.29 am to 01.19 pm (Colombo Time).

The lunar eclipse that is to occur on Sunday 05th of July, is expected to be a Penumbral Lunar Eclipse and based on astronomical reports, this may not be visible to Sri Lanka.

The Prophet (PBUH) has said, “The sun and the moon are two signs amongst the signs of Allah; they do not eclipse on the death or life of anyone. So when you see the eclipse, Remember Allah and say Takbir, offer Prayers and give Sadaqa.”

If anyone sights the Solar Eclipse or if many people have reported to have sighted the Eclipse which is expected to occur on Sunday, 21st of June, the Eclipse prayer could be performed.

As performing the Eclipse prayer in congregation is an emphasized Sunnah, the ACJU Hilaal Division urges the Masjid Trustees and Ulama to make arrangements to conduct this Prayer in congregation, while abiding by the related guidelines, limitations on the number of persons permitted and social distancing measures according to the instructions issued by the Health Authorities.

Regarding the performance of Jumu’ah Prayer on 2020.06.19

1. Indeed, there is no doubt that each and every person would be eager to perform the Jumu’ah prayer. However, as it is not possible to accommodate everyone for Jumu’ah prayers under the current situation, those who are compelled to forego Jumu’ah will undoubtedly receive the reward of actually performing Jumu’ah.

2. As it is not possible to accommodate everyone for Jumu’ah prayers while maintaining social distancing within Jumu’ah Masjids, the Waqf Board, Muslim Religious and Cultural Affairs Dept. (MRCA) and the ACJU has issued guidelines to utilize Zaaviyahs, Thakiyyahs and other suitable locations to perform the Jumu’ah prayers by obtaining the necessary permissions from the relevant Authorities.

3. In this regard, everyone is kindly requested to fully cooperate with the Masjid Trustees, and only those who have been permitted to perform Jumu’ah are requested to do so; while others are kindly requested to perform the Luhar prayers, on time, in congregation, at their respective places.

4. We request the Masjid Trustees and the ACJU Divisional Branches to collectively decide on an appropriate method for granting permission to perform Jumu’ah.

5. It should be ensured that the related permissions that have been granted should not be violated due to our misconduct under any circumstances.

6. Currently, as the Government has granted permission to perform Jumu’ah prayers, it is obligatory that Jumu’ah is performed by the number of persons permitted by the Government at possible venues by obtaining necessary approvals from the Authorities. It is not permissible to neglect this obligation while having the capability to perform it.

7. It is incorrect to forego the performance of Jumu’ah, citing the reason that only few shall have the opportunity to perform Jumu’ah and many others may not.

Guidance on conducting Jumuah during the present COVID-19 situation

Conducting Jumuah is from amongst the fundamentals of the religion. Many a guidance has been provided and specific conditions have been mentioned in regards to it. It is incumbent upon every Muslim to adhere to them. Furthermore, considering the unfamiliar situation of COVID-19, it is also important to follow the guidelines issued by the relevant officers and the Ministry of Health when holding a Jumuah congregation.

 

1. The health officers have limited the number of people gathering at religious sites, in order to prevent the spread of COVID-19. Gathering in numbers exceeding the said limit should be avoided.

 

2. According to the Shafie School of Thought (Mad’hab), a minimum of 40 matured males, who are permanent residents, is required for the validity of Jumuah Prayer. Hence, if due to space constraints, or permission not being granted by the officers, or for any other reason, the number of attendees is less than 40, then Luhar Salah has to be conducted.

 

3. A concession could be provided to conduct Jumuah at various venues in a town, due to space constraints. Considering the above and the fact that performing Jumuah Prayers is not possible while maintaining Social distancing, Jumuah Prayers could be conducted at Jumuah Masjids as well as other Masjids, Thakkiyas, Zaviyas, etc. However, advice should be sought from the branch Jamiyyahs and permission should be taken from the health officers before taking the above mentioned steps. Moreover, should the Health Officials (PHI) grant permission, Jumuah could also be conducted at Madrasas, Halls and public places.

 

4. Generally, if one is unable to attend Jumuah prayers due to illness, travel, fear, rain or any other restrictions, he will be exempted from performing the Jumuah Prayers.

 

5. Since the government has restricted the number of people that could gather in a place, to prevent the spread of COVID-19, and keeping in mind the difficulty in maintaining Social distancing whilst performing Jumuah, praying Luhar would suffice for those who are unable to attend the Jumuah prayers. In a state of compulsion, if one is unable to perform Jumuah prayers, it will not be deemed a sin; instead, he will be rewarded.

 

6. The residents should fully cooperate with their respective Masjid administrators in this matter; and those who are able to may conduct the Jumuah prayers, while others should conduct the Luhar prayers.

 

7. Be mindful of the instructions provided by the Waqf Board and the Department of Muslim Religious and Cultural Affairs too, as they are responsible for the affairs of the Masjids of the country.

 

Note: The concession granted to conduct Jumuah in many places is valid only during the period of the COVID-19 crisis. Once this crisis is over and the nation reverts back to normalcy, the practice of conducting Jumuahs in many venues should discontinue, and Jumuahs should be conducted only in places where they used be conducted before the crisis. This would be in accordance to the religious rulings in regards to Jumuah.

Opinion regarding disposal of COVID-19 affected human remains

In the Name of Allah, the Most Gracious the Most Merciful

Our opinion (fatwa) has been sought with regard to the permissible mode of disposal of the remains of persons who have succumbed to COVID-19.

 

The fatwa committee has submitted an exhaustive report on this issue. We have taken note of the opinions of established Islamic scholars and the Qur’anic injunctions referred to in the report.

 

We note that all four schools of Islamic jurisprudence are unanimous that the only permissible method of the disposal of the remains of a deceased is by burial. A departure from this rule is recognized only in exceptional and unavoidable circumstances. A recognized exception is that of a person dying whilst on a sea journey, and access to land within a reasonable time is not feasible. Upon a consideration of all the available text and Qur’anic injunctions in the light of available scientific material, we are of the opinion that a departure from this general rule to justify cremation in the disposal of COVID-19 affected human remains is not permissible for the reasons set out below.

 

We note that it has been almost universally recognized that the burial of deceased COVID-19 patients is an accepted method of disposal. This is subject to the adoption of recognized measures, if need be, in certain circumstances to prevent the transmission of the disease by the pollution of water or by rodents. To the best of our knowledge Sri Lanka and perhaps China appear to be the only countries to have confined the disposal of human remains affected by the COVID-19 virus to cremation.

 

The World Health Organization (WHO) in its Guidelines issued on 24.03.2020, for the disposal of COVID-19 infected human remains observed as follows.

“People who have died from COVID-19 can be buried or cremated (WHO, 2020).”

 

We have also taken note of Chapter 2.7 of the General Guidance for the management of the dead related to COVID-19 issued by the International Committee of the Red Cross (ICRC) which also mentions that

“Cremation of unidentified human remains should be avoided, and burial in single graves is the preferred method of disposal. (Finegan, et al., 2020)”

Hence, we are satisfied that the recognized international public health organizations are of the opinion that the available scientific material does not warrant a departure from the Islamic requirement that the remains of a deceased COVID-19 patient should be buried and not cremated. In any event, the availability of recognized precautionary measures to counter the possibility of the transmission of the disease, in case of burials, has not been properly appreciated by the public health authorities in Sri Lanka.

 

We wish to emphasize that Islam enjoins us to obey the law. Therefore, this opinion should not be understood as a justification to disobey the law.

 

We have made representations to the authorities to reconsider their decision to prohibit burials of deceased COVID-19 patients. We reiterate our position that there should be a free choice and that we Muslims, should be granted the option to conform to the religious requirements of our faith that such deceased persons should be buried. We are saddened by the fact that our representations and that of medical personnel and activists did not find favour with our public health authorities.

 

We appeal to all citizens to co-operate with the government to eradicate the virus from our motherland. May Almighty Allah bless us and keep us all safe.

ACJU Message on Eid-Ul-Fitr

The ACJU conveys its greetings, on the blessed Day of Eid-Ul-Fitr, to all Muslims who had observed fasts and engaging in good deeds in the Month of Ramadhaan, and are celebrating Eid today, despite the prevailing Covid-19 crisis. We pray that Almighty Allah accepts our Fasts and showers the best of His rewards abundantly upon all of us.

Considering the safety of the country and its people from the effects of Covid-19, arrangements should be made to celebrate Eid in a simple manner within our homes and among our household members, abiding by guidelines of the Health and Govt. authorities with responsibility.

We pray to Almighty Allah to bless us with unity and determination to strive to protect our Motherland from this infectious disease.

On this blessed Day, while observing the Islamic practices according to its Teachings, we should pray for our Motherland and for the entire world to be relieved from the effects of this pandemic.

On this Day of Eid, the ACJU wholeheartedly extends its gratitude towards the Government, Health Authorities, Tri-Forces, Police officers, and all other front liners who are striving continuously to serve the Nation with utmost dedication despite the tough conditions.

Assalamu Alaikum Warahmathullaahi Wa Barakaathuhu!

Guidelines Regarding the Eid-Ul-Fitr prayers for this year

  1. According to the instructions given earlier, considering the situation in the country, festival prayers should be conducted with Jama’ath in the houses.
  2. Performing the festival prayer is Sunnah Mu’akkadah. Though there is permissibility to perform this prayer alone, it is recommended to perform it with Jama’ath.
  3. The festival prayer could be performed from the moment the sun has risen, until it reaches its zenith. Yet it is preferred to pray after the sun has risen above the horizon to the height of a spear (after 15 minutes).
  4. There is no Athan or Iqamath for the festival prayer.
  5. The festival prayer consists of two Rak’aths. Initially, one should keep the intention of praying two Rak’aths of Festival prayer, then say the Takbeer and fold his hands. It is a Sunnah to recite the Wajjahthu Dua. Other similar Duas that are reported in the Ahadith could also be recited.
  6. Thereafter one should say the Takbeer 7 times, similar to the first one, by raising the hands and folding them. Likewise, even in the second Raka’ath, 5 extra Takbeers will be pronounced, apart from the Takbeer pronounced when standing up from from Sujood. Dhikrs such as the one mentioned below can be recited in both Raka’aths:

سُبْحَانَ اللهِ، وَالْحْمدُ لِلّهِ، وَلَا إِلهَ إِلَّا اللهُ، وَاللهُ أَكْبَرُ  

  1. It is obligatory to recite Surah Fatihah after having pronounced the extra Takbeers in both the Raka’aths. It is Sunnah to follow it up with the recitation of a Surah. If one hasn't memorized any other Surahs, it will be sufficient to recite only Surah Fatihah.
  2. It is a Sunnah to recite Surah A’la (الأعلى) in the first Raka’ath, and Surah Ghaashiya (الغاشية) in the second Raka’ath, for those who know them by memory.
  3. If a person chooses to pray alone, he shall perform the two Raka’aths of the Festival Prayer only.
  4. The Khutbah could be delivered if two or more persons are present. The number of people required for the validity of Jumu'ah will not be required for the validity of festival prayer.
  5. Conducting the Khutbah after the Festival prayer is a Sunnah. The Khutbah of Eid is similar to the Khutbah of Jumu'ah, with the addition of 9 Takbeers at the beginning of the first Khutbah, and 7 Takbeers at the beginning of the second Khutbah.
  6. It is necessary to mention the following in Arabic during both the Khutbahs of the Festival prayer, just as it is necessary to mention them in the Jumu'ah Khutbah:

Furthermore, a Verse from the Quran must be recited in both the Khutbahs. The second Khutbah must be concluded with Dua, by supplicating for the believers: اللهُمَّ اغْفِرْ لِلمُؤمِنِيْنَ والمُؤْمِنَاتِ] A sample Khutbah has been attached.

  1. A sermon could be delivered following the Khutbah, if one wishes.
  2. If there is no one who could recite the above and conduct the Khutbah, it will be permissible to suffice with the prayer alone, as the Khutbah is not a condition for the validity of festival prayer.
  3. While performing the prayer in congregation (Jama’ath) males must do the Imamath.Y In the case where only women are present in the congregation, one of the women could lead the prayer. In such a situation, Khutbah will not be read by women. A woman amongst the congregation of women may choose to deliver a small sermon.
  4. Considering the present circumstances in the country, one should conduct the festival prayer and Khutbah within the confines of the home among the household members only. And neighbors or outsiders should not join under present circumstances.
  5. Those upon whom Zakatul Fitr is obligatory should discharge it prior to the festival prayer.
  6. The Sunnah activities of the day of the festival should be carried out, considering and respecting the rules and regulations of the country.

A Sample Eid Khutbah which can be read

First Khutbah :

 

اللَّهُ أَكْبَرُ  اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ  اللَّهُ أَكْبَرُ اللَّهُ أَكْبَرُ الْحَمْدُ لِلَّهِ وَالصًّلاَةُ وَالسَّلَامُ عَلَى مُحَمَّدٍ رَسُولِ اللَّهِ صَلّى الله عَلَيْهِ وَسَلًّمَ. أٌمّا بَعْدُ

Message of Condolence from ACJU on the demise of Marhoom Dr. M.A.M. Shukri

The message of the demise of Dr. M.A.M. Shukri brings great grief to all of us.

Marhoom Dr. M.A.M. Shukri who was one of the most prominent educationalists of Sri Lanka, and the Director of ‘Jaamiyya Naleemiah’ Institute of Islamic Studies – Beruwala, passed away today (19.05.2020). Innaa Lillaahi Wa Innaa Ilaihi Raajioon. His departure is an immense loss for the people of Sri Lanka.

Dedicating his life towards the missions of academic and Deen, Dr. Shukri had productive affiliations with ACJU as well. He never hesitated in disseminating valuable advice and guidance in the hours of need. He has participated and delivered thesis orations at many conferences and seminars organized by the ACJU.

Having authored several manifold books, he has served as a lecturer at many Universities in Sri Lanka. As a mentor for thousands of students, he always maintained a neutral approach in his affairs, and maintained a close relationships with the Ulama.

He was known for being passionate towards the academic administration at ‘Jaamiyya Naleemiah’ and his academic contributions continued until his last breath. As a result he is accredited with pride for producing many scholars to this nation.

May Almighty Allah accept all his good deeds, forgive his sins, and associate him among His faithful slaves, May Allah bestow peace and patience to his family, students and associates, Aameen.

Guidelines regarding the last days of Ramadhaan and the Day of Eid

Having observed the fasts of Ramadhaan amidst the COVID-19 pandemic, we have reached the last few days of this blessed Month.

While we pray for quick relief from the impact of this virus and restoration of normalcy in our livelihoods, during this Holy Month of Ramadhaan, we request everyone to follow the below guidelines.

 

Guidelines regarding the last part of Ramadhaan:

  • The last part of Ramadhaan is in which most virtues could be acquired. Therefore, everyone should engage in good deeds excessively during this period, while remaining at homes, and make effort to attain the blessed ‘Laithul Qadr’.

 

  • Gatherings at Masjids for I’thikaf and other Ibaadahs (acts of worship) during these few days should be completely avoided and the related guidelines issued by the Waqf Board and the Department of Muslim Religious and Cultural Affairs (MRCA) should be followed.

 

  • Since the curfew is being relaxed partially in many districts, unless for essential needs, leaving the homes should be avoided and if required to go out it is necessary to abide by the guidelines issued by the government such as wearing a face mask and maintaining social distance. As it is the teaching of Islam in such situations to adhere to the set guidelines, as above, the Muslim community should follow them in an exemplary manner.

 

  • During the forthcoming Eid season, we should completely refrain from gathering in large crowds to make purchases, and follow the related guidelines set by the Government and the Health Ministry and as a precautionary measure, we should resort to ‘Home Delivery’ services, as much as possible, to make necessary purchases.

 

  • Those upon whom Zakathul Fitr is obligatory, should ensure to offer them prior to the performance of the Eid Prayer. As advised previously, it is recommended to offer it collectively through the Masjids.

 

Guidelines regarding the Day of Eid:

  • While being conscious that this Eid has to be celebrated during a crisis period, we should ensure to abide by the standard precautionary measures considering the safety of the people and the country, especially on the day of Eid.

 

  • Performing the Eid prayers in congregation at Masjids or in open grounds should be strictly avoided. Instead the Eid prayers should be conducted within the house hold members at our homes.

 

  • Necessary arrangements should be made to celebrate Eid safely, within the household members. Unnecessary trips and gatherings should be strictly avoided.

 

  • Strictly avoid making Musaafaha or Mu’aanaka with others during this period, especially on the day of Eid.

 

  • From the moment of sighting the crescent of Shawwaal until the Eid prayers are performed, necessary arrangements should be made to recite Takbeer over the loudspeakers of the Masjids, after every Azan.

 

  • Assistance should be provided to the poor and needy as much as possible, especially during the period of Eid.

 

May Almighty Allah accept our good deeds and fasts, and safeguard the entire world from the effects of this virus. Aameen.

Some guidelines on carrying out the Zakathul Fitr this year

1. Zakatul Fitr is a charity that becomes obligatory when the crescent for the month of Shawwal is sighted, upon those who can afford it. The Prophet (PBUH) said, “Zakatul Fitr purifies the sins of a person who has fasted, and is a sustenance for the poor.”

2. Generally, Zakatul Fitr becomes obligatory upon the sighting of the crescent for Shawwaal. However, according to the Shafi Mad’hab, it can be discharged from the time the crescent of Ramadhan is sighted.

3. Although it would be permissible to give the equivalent monetary value according to the Hanafi Mad’hab, majority of the scholars like Imam Malik, Imam Shafi and Imam Ahmed share the view that the main grain that is consumed has to be given. It cannot be replaced with its equivalent monetary value. This is the most authentic view.

4. The amount payable as Zakatul Fitr “one Saa’”, i.e 2.4 Kilogram per person.

5. Due to the prevailing situation in the country, it would be very difficult to look for those in need and pay the Zakatul Fitr to them personally.

6. We urge the prominent people of the town/Masjid Boards/charity organizations that function in the town to make the following arrangements:
• Decide the value of 2.4 Kilogram of rice, define a payment period,
• Make a public announcement that this would be issued to the needy,
• Collect the payments from those who could afford to pay,
• Purchase the rice on behalf of them,
• Thereafter distribute them among those who are eligible to receive Zakath, before the festival prayers.
